A decision to exclude a club for one year from UEFA competitions, following match-fixing events that occurred 5 years earlier, is neither time-barred, disproportionate or contrary to the principle of equal treatment.
Facts/Procedure
According to the findings of the Football Federation of Ukraine (FFU), a football match played in 19 April 2008 between the Ukrainian football clubs FC Karpaty and FC Metalist (the Club or the Appellant) was fixed. The FFU subsequently sanctioned Mr Krasnikov, an FC Metalist official for his involvement. The two clubs were held liable under the principle of strict liability. A CAS procedure ensued.
