On 3 February 2020, CAS stated that neither Article 9 of the FIFA Regulations Governing the Application of the FIFA Statutes nor any other provisions incorporated in the relevant FIFA, CONCACAF, and USSF regulations require that the principle of promotion and relegation be implemented in professional soccer in the United States.

On 29 and 30 May 2008, the FIFA Congress adopted Article 9 of the FIFA Regulations Governing the Application of the FIFA Statutes (RGAS), which provides for clubs to be entitled to take part in the domestic league championship on sporting merit (promotion and relegation system). In addition to qualification on sporting merit, Article 9 also provides that a club’s participation in a domestic league championship may be subject to other criteria within the scope of the relevant licensing procedure.
