For an arbitral tribunal to have jurisdiction, it is required that both parties had consented to arbitration by such arbitral tribunal concerning the agreement that constitutes the legal cause of the dispute at stake.

Facts and Procedure

 

On 9 August 2017, a player concluded an employment contract with a club valid from the date of signature until 30 June 2018. The contract, which was registered with the Hellenic Football Association (HFF), stated: “all disputes between the parties are settled by the Appeals Committee for the Resolution of Financial Disputes (FEEOD) at first instance, and the Court of Arbitration of the HFF at second instance.”

The parties also signed an additional agreement that increased the player’s salary but was not registered with HFF.
