What are the legal consequences of the COVID-19 crisis on the contracts between clubs and players? Do you think that players can refuse a salary reduction?
In Portugal, the principle of irreducibility of the remuneration constitutes one of the guarantees of the employee in the context of the employment relationship, resulting from the impossibility of reducing the employees’ remuneration, except for the cases provided for in the labor code or in a collective labor regulation instrument. Outside these cases, players can indeed refuse a salary reduction. Actually, the decrease in remuneration - namely by mere agreement with the worker - is not allowed by law and constitutes a very serious administrative offense.
