The EU General Court ruled that a third party who filed a registration for the trade mark “Neymar”, while knowing that Mr Neymar was a rising star in international football and not having any other motive to register the trade mark than to exploit Mr Neymar’s renown, acted in bath faith. The registration for the trade mark was therefore rightfully invalidated.
Facts/Procedure
On 17 December 2012, Mr Carlos Moreira (the Applicant), a Portuguese resident, filed an application for registration of an EU trade mark with the European Union Intellectual Property Office (EUIPO). The trade mark was registered in respect of clothing, footwear and headgear on 12 April 2013.
