It is a firmly enshrined principle in CAS jurisprudence that a party against which a disciplinary measure is issued must have the possibility (orally or in writing) to defend itself against the charges forming the matter in dispute during the said disciplinary proceedings.

Facts and Procedure

 

The Group Stage of the 2019-2020 edition of the CAF Champions League took place between 29 November 2019 and 1 February 2020. As a result, the club was drawn into Group B along with Étoile Sportive du Sahel, Al Ahly and FC Platinum. On 1 February 2020, the club played a final group stage home match against Al Ahly. During the course of the said match, match officials reported numerous issues and incidents, including objects being thrown onto the football pitch, insults towards Al-Hilal officials and the use of laser lights.
