Breach of Contract: CAS 2019/A/6463-6464 Saman Ghoddos v. SD Huesca and Östersunds FC and Amiens SC and FIFA

CAS set aside the economic part of a FIFA DRC decision dealing with a breach of a transfer agreement between two clubs. According to CAS, the suffering club never paid the relevant transfer fee sum agreed-upon to transfer a player or the said Player’s contractually agreed salary.

Facts and Procedure

 

The legal saga started in August 2018 when SD Huesca, a Spanish club, put in doubt Mr Ghoddos’s (the Player) signing when it contacted FIFA to enquire about the validity of their agreement to sign the Iranian Player. At that moment, the Player had signed a contract with SD Huesca club while he had a written agreement with Östersunds.
