A decision that imposes a prospective ban on a debtor following the non-payment of a financial obligation is not contrary to FIFA Regulations or Swiss Ordre Public, even if the creditor is allowed to choose whether or not the ban should be enforced.

Facts/Procedure

On 15 April 2010, Mr Eboué (the Player) and his agent Mr Boisseau (the Agent) concluded an exclusive two-year representation agreement.

On 13 February 2012, the Agent lodged a claim against the Player at FIFA explaining that the Player had breached the agreement when he transferred in August 2011 from Arsenal to Galatasaray, by using the services of other authorised agents.
