A 2-year ban from any football-related activity does not violate the concerned individual’s right to exercise a profession or enjoy its economic freedom. On the contrary, the respective sanction simply limits its capability of performing any football activity, during a temporary and limited period of 2 years.
Facts/Procedure
Ion Viorel (the Coach, the Appellant) was involved into match-fixing and sanction by his National Federation (the Respondent).
On 20 September 2014, within the Liga 2 of the Romanian Championship, a match was scheduled to be played (Match 1).
On 22 September 2014, within the UEFA Betting Fraud Detection System (BFDS), the company Sportradar issued a report with regard to Match 1, in which it concluded that the betting patterns combined with other elements described in the report “show clear indications that bettors had prior knowledge of the result” and that “this match is considered highly suspicious and most likely manipulated for betting purposes.”
On 27 September, another match was played, displaying one of the clubs from Match 1. This match was called Match 2....
