In the present case, the Sole Arbitrator decided that the New CSKA Sofia is the Old CSKA Sofia’s sporting successor and can thus be held liable to comply with the former club’s financial obligations. However, the Sole Arbitrator found that the Creditor did not act with due diligence in recovering her debt in the Old CSKA Sofia’s insolvency proceedings. That is why he ruled not to sanction the New CSKA Sofia.
Brief Facts
In August 2013, the Single Judge of the FIFA Players’ Status Committee (FIFA PSC) ordered the club, PFC CSKA Sofia (Old CSKA), to pay the agent, Soukeyna Ba Bengelloun (the Creditor), a certain sum for an outstanding agent fee (2013 PSC Decision).
In March 2015, the FIFA Disciplinary Committee (FIFA DC) sanctioned the Old CSKA for failing to comply with the 2013 PSC Decision.
In October 2015, the Sofia City Court opened insolvency proceedings against the Old CSKA. Consequently, FIFA suspended the disciplinary proceedings against the Old CSKA.
In September 2017, the Bulgarian Football Union informed FIFA that the Old CSKA was declared bankrupt and, as a result, disaffiliated.
