CAS 2023/A/9443 Anatoliy Tymoshchuk v. Ukranian Association of Football (UAF)

On 18 November 2024, the Court of Arbitration for Sport (CAS) annulled all sanctions imposed on Anatoliy Tymoshchuk (Tymoshchuk) by the Ukrainian Association of Football (UAF). The sanctions, including a lifetime ban and the revocation of his titles, were based on Tymoshchuk’s failure to publicly condemn Russia’s invasion of Ukraine and his continued work in Russia. The Panel found that the UAF lacked a valid legal basis for its actions and that Tymoshchuk’s conduct, including a peace-focused social media post, did not harm the reputation of Ukrainian football.

Facts and Procedure

The case arose after the UAF sanctioned Tymoshchuk, a former Ukrainian football legend and assistant coach at Zenit St. Petersburg, for his behavior following Russia’s invasion of Ukraine on 24 February 2022. On that day, Tymoshchuk posted an Instagram story calling for peace, featuring the message “We need peace. For the sake of our children...
