The task of the CAS Panel is limited to reviewing whether or not a licensing authority made correct use of its discretion to grant a license to a club if considerable leeway is granted by the applicable regulations to the licensing authority.

Facts/Procedure

On 1 February 2017, following a proposal submitted by FC Koper (the Club) on 3 November 2016, the District Court in Koper issued a decision to initiate the proceedings of a compulsory settlement against the Club. This was noticed to all the creditors of the club.

On 31 March 2017, the Club, in accordance with the Football Association of Slovenia Club Licensing Regulations (the NZS CLR), filed an application for a license to participate in UEFA competitions as well as in the Slovenian first division for the competitive season of 2017-2018. Both...
