The failure to name another party in a Statement of Appeal cannot be remedied after expiry of the appeal deadline through joinder, intervention, an Article R56 submission or informal correspondence from the said party.

 

Facts and Procedure

 

On 3 February 2025, AS Saint-Étienne (ASSE), Chelsea FC and the professional player Mathis Amougou (the Player), born on 18 January 2006, entered into a permanent transfer agreement (Transfer Agreement) for EUR 15 million, payable in four instalments. Under Article 5 of the contract, Chelsea was to calculate and distribute the applicable solidarity contribution to the entitled former clubs, expressly including ASSE; such amounts were comprised within the transfer fee and Chelsea could deduct solidarity due to third clubs from the sums payable to ASSE.
