Any contractual clause under which only the club, but not the player, may unilaterally terminate the employment contract is unilateral and potestative and therefore contrary to FIFA Regulations.

On 14 August 2011, Zamalek Sporting Club (the Club) and the Ghanaian player Karim Alhassan (the Player) entered into an employment agreement (the Agreement). The Player’s remuneration was payable in monthly instalments, and two extra instalments (one at the beginning of the season and another at the end of it).
On 8 or 18 May 2012 (the translations made by the Parties differed), the Club sent a letter to the Player indicating it did not wish to continue with the Agreement and that it deemed that the parties’ respective financial claims against each other as settled.
