By decision of 6 November 2025, the Swiss Federal Tribunal (SFT) dismissed a civil law appeal lodged by an Argentinian football agent (Appellant or Agent) against a decision of the Court of Arbitration of Sports (CAS) dated 7 March 2025 (CAS 2023/O/10217), by means of which the CAS declared itself incompetent to hear a claim directed against an Italian professional football club (Respondent or Club).
The Appellant alleged that the CAS Panel wrongly declined jurisdiction by refusing to extend the arbitration clause contained in a commission agreement with a now-defunct Italian club to the Respondent, which it considered to be the sporting successor of the original contracting party. In a second ground, the Appellant claimed a violation of its right to be heard, alleging that the Panel failed to examine material aspects of its argumentation.
