CAS 2015/A/3884 Football Club Volga v. Football Union of Russia & Vladimir Nikolaevich Malyshev
By the arbitral award dated 26 November 2015, the Court of Arbitration for Sport confirmed the decision of the Players’ Status Committee of the Football Union of Russia in a dispute between Russian club FC Volga and its senior coach Vladimir Malyshev, recognizing that factual circumstances of the case may lead to conclusion that the employment contract was tacitly terminated, despite no formal termination procedure was observed.
Brief facts
The Regulations of the Football Union of Russia (FUR) on Licensing of Football Clubs in the Russian Federation stipulate that an applicant to the license shall appoint a qualified coach who assists the chief coach on all matters related to training and competition activities of the first team. The coach of the first team shall have, at least, one of the following qualification documents:
- a valid coaching diploma and a valid license of not below UEFA A Grade (or equivalent);
- a certificate that this coach is a trainee (undergoes training) of a training course recognized by the RFU and allowing him/her to obtain a coach diploma and a license of the required grade. The mere registration with such
course is insufficient to meet the requirement.
