As it has already been previously described in Football Legal*, the case of the Player Filipe José Machado (the Player), from Brazil, against the Club Saba Qom Football Club, from Iran, regarding overdue salaries and bonus provided in the employment contract, is landmark in the FIFA’s proceedings. The importance of the case is due to the fact that the FIFA Disciplinary Committee recognized the Player’s widow, Ms Aline Penteado Pereira Machado, as creditor of the relevant decision, after the tragic death of her husband in the Chapecoense’s plane crash, occurred in November 2016.
However, after overcoming the difficulty in recognizing the widow as a creditor of FIFA's decision, the succession of the Player (that comprises the widow and their fiveyear-old daughter) is now facing the limitations of FIFA's enforcement of its monetary decision, which is based in a system of imposition of disciplinary sanctions on the debtor in the case of default.
