In an award delivered on 1 May 2017 (CAS 2016/A/4473 Liberia Football Association v. FIFA), the Court of Arbitration for Sport (CAS) shed light on an issue that had remained relatively controversial until then, namely the enforcement of settlement agreements reached after a decision either by the Dispute Resolution Chamber (DRC) or the Players' Status Committee (PSC).
The Interpretation of the CAS
In the referred decision, the CAS had to analyse the Disciplinary Committee’s scope of review in connection with these post-decision agreements.
In this respect, the CAS emphasised that “there can be situations when the FIFA Disciplinary Committee is required to make a more thorough analysis than simply verifying whether the amounts awarded in the final and binding decision have been paid.”[1] As an example, the CAS highlighted the situation in which a creditor and a debtor have agreed on a payment schedule...
