The New “Trans Law”: its Influence on Spanish Sport


On 29 June 2021, the Spanish government approved a preliminary draft law, promoted by the Ministry of Equality and Ministry of Justice, for the absolute and effective equality of trans people and for the guarantee of LGTBIQ+ rights, which establishes as its primary measure that people over 14 years of age can change their sex without any means of proof to do so. In contrast to the previous paragraph, the legal text establishes that minors aged 12 and 13 will need judicial authorization to request a change of sex at the Civil Registry.

Historically, to complete sex changes, it was necessary to obtain health reports and legal and medical guardianships. With this draft law, the only requirement to request a sex change would be the applicant’s will.

In order to avoid fraud of the law, it is essential to mention that the law establishes a mechanism to avoid the continuous change of sex. So, people who have changed their sex in the Civil Registry can only reverse it once after a minimum of six months and with judicial authorization.

In addition to what has been mentioned so far, the aforementioned legal text prohibits conversion or aversion therapies intending to modify sexual orientation and identity.
