In March 2017, the formation of the new Joint Arbitration Commission (Comissão Arbitral Paritária - CAP), formed pursuant to the Collective Bargaining Agreement signed between the Portuguese Professional Football League (LPFP) and the Professional Football Players Union (SJPF), published in Labour and Employment Bulletin no. 8 of 28 February 2017, was in the news.
I am not going to add to the controversy regarding the composition of this body, but will focus on another issue that I consider to be more important: what is this body for and what is its role?
The main novelty is this: while the essential mission of the previous CAP was “to decide employment disputes between football players and clubs or sports companies”, the new CAP has a more limited role: i.e. “to confirm the termination for sports purposes, in cases of unilateral rescission by the player” (when invoked by the player in cases...
