Interview on the New FIFA Football Agents Regulations – Legal Challenges

On 6 January 2023, FIFA announced that its brand-new Football Agents Regulations would come into force on 9 January 2023 after being approved by the FIFA Council in late December 2022. Most of the regulations, including the requirement to use only licensed football agents and the cap on agent fees, will come into force on 1 October 2023. Several legal actions are currently underway or in preparation to challenge the legality and legitimacy of these Regulations. Joint interview with members of the team working on the European Football Agents Association’s (EFAA) legal challenge to the new FIFA Football Agents Regulations (FFAR).

Football Legal: Jade Versteeg, Bas Braeken, you are specialized in European competition law and recently intervened in the Ice Skating Union (ISU) case before the European courts. Can you introduce yourself in more detail and tell us about your role and contribution to the ISU case?

Bas Braeken & Jade Versteeg: We are competition lawyers, active across the full spectrum of competition law and sector-specific regulation. In our work, we specifically have experience in certain sectors, including communications, transport, agriculture, gambling and - of course - sports.

We got involved in the ISU case after the Commission decision was adopted, and ISU appealed that decision. We represented both the European Elite Athletes Association (EU Athletes) and the two individual Dutch speed ice skaters that filed the complaint with the European Commission against the Eligibility Rules of ISU.
